§1. Generally

These terms of purchase (the "Agreement" below) are adapted for sale on the Internet (distance selling). Byswedes AB (Organization number: 559244-7493) is the selling party. The Purchasing Party is referred to as the "Customer" in this Agreement. The terms of the Agreement are adapted for sale to private individuals over the age of 18 and to traders domiciled in Sweden and for the sale of goods ("products" below). With us, you as a customer can easily place an order at https://www.bySwedes.com ("Website" below) or via e-mail.

The provisions of this agreement do not apply to agreements on purchases entered into before 13 June 2014. To increase clarity, there is a date marking in the header. If the terms of the Agreement have changed, an end date is also stated. If the end date is stated, the Agreement applies until 00:00 the date on which the Agreement ceased to apply. You as a customer are given the opportunity to accept these terms in connection with your order.

Terms or parts thereof in this Agreement that deviate from mandatory legislation are without effect to the extent that the deviation is not in favor of the customer. This provision only applies if the customer is a private person and that the purchase refers to private consumption.

§2. Ordering

At Byswedes AB, you order products easily and conveniently. We offer secure payment options and secure deliveries. Byswedes AB receives your order when you click on the "Order" button at checkout (step 1 of 1). By clicking on the "Order" button, you as a customer also accept payment responsibility for your order. When Byswedes AB has received your order, you will receive the e-mail "Thank you for your order!" to the email address you provided when ordering. Byswedes AB also offers customers to place an order via e-mail to: order@byswedes.se. When you click on the "Order" button, this Agreement is concluded.

Shop safely with the right to change your order
Should you change, you also have the opportunity to change your order. To change the order, please contact us via e-mail at: order@byswedes.se.

§3. Prices and fees

Prices are stated in Swedish kronor (SEK) including VAT (VAT) according to the current tax state. VAT for products subject to VAT is charged at either 25% or 6%. Fees for shipping may be added to each order, see §7. Delivery in the Agreement for more information.

Fee for uncollected shipment
If you as a customer should not collect your order in the manner agreed, we will charge a fee of SEK 250 including VAT. The fee is necessary for us to be able to cover shipping and handling costs that arise. Note that if you do not receive or pick up a shipment, it does not count as if you have announced that you have regretted your purchase. For more information see §8. Right of withdrawal and repurchase below.

Offers
Offers and promotions marketed on the website apply as long as the stock lasts if no other conditions are reported in connection with the offer.

§4. Products and range

All products offered on the website are adapted for use on the Swedish market. This means, among other things, that the products meet Swedish environmental requirements and safety regulations. Normally, instructions for use in Swedish are included if required for the product's use. Any technical specifications, special requirements for accessory equipment and information on restrictions and seals appear on each product page to the extent that it is reasonable or required by law.

§5. Payment

Byswedes AB offers card payment via our payment partners Strype and PayPal who are authorized with PCI DSS certification. Your card information is transferred and stored securely in encrypted form. The card is charged when you as a customer have completed your order, card payment is possible with the following card types:

§6. Fulfillment

Byswedes AB starts fulfilling this agreement when you click on the "Order" button at checkout. Byswedes AB has fulfilled its part of this agreement when you have received full delivery of ordered products in your possession. You as a customer have fulfilled your part of this agreement when you have paid in full and received delivery of ordered products in the manner agreed.

§7. Delivery

Products are delivered directly to the address you provided when ordering, or via an agent in collaboration with our logistics partners. Byswedes AB sends orders during non-holiday weekdays.

Shipping cost:

The total shipping cost for an order is stated at checkout:

-Shipping cost for Goods Letter is SEK 39 including VAT.
-Shipping cost for Packages is SEK 39 including VAT.
-Shipping cost for Home Package is SEK 39 including VAT.

Byswedes AB offers free delivery if the value of ordered products exceeds SEK 800 including VAT.

Delivery time:

If the delivery times stated below are not applicable to a purchase and if a delivery time has not been specifically agreed outside this agreement, Byswedes AB undertakes to fulfill delivery without unnecessary delay, but no later than within 30 days from the conclusion of the agreement. In the event that the customer is to pay in advance, Byswedes AB reserves the right to wait for payment before delivery begins.

Delivery times are given below. If the order includes products that are out of stock, the delivery time may be longer than normal. In that case, the order is only delivered when all products are in stock.

Goods letter in collaboration with Posten (Standard shipping)
Consignment notes are delivered within 1-2 non-holiday weekdays from the day when the order is sent from Byswedes AB's warehouse. In the event that the item cannot be delivered through your mailbox, you will be notified and can then pick up the item according to the instructions given in the notice. If you have selected SMS notification, you will be notified when the consignment can be picked up from the agent. Notified consignment sent as a Goods Letter must be picked up within 14 days. Uncollected shipments are returned to Byswedes AB, you as a customer will then be charged a recovery fee of SEK 250 including VAT. Consignment notes are a traceable shipping option.

Packages in collaboration with Posten (Standard Shipping)
Packages are delivered within 2-3 non-holiday weekdays from the day when the order is sent from Byswedes AB's warehouse. You will be notified when you can pick up the package from your agent. If you have selected SMS notification, you will be notified when the consignment can be picked up from the agent. Packages must be picked up within 14 days from the date of notification. Uncollected shipments are returned to Byswedes AB, you as a customer will then be charged a recovery fee of SEK 250 including VAT. Packages are a traceable shipping option.

Home package in collaboration with Posten (Standard shipping)
Home packages are delivered within 2-3 non-holiday weekdays from the day when the order is sent from Byswedes AB's warehouse. Home packages are delivered to the door, 3 delivery attempts are included. In the event of further delivery attempts, charges may apply, so always contact Posten if you are unable to receive the shipment on time. Home packages that could not be handed over are returned to Byswedes AB, you as a customer will then be charged a recovery fee of SEK 250 including VAT. Home packages are a traceable shipping option.

Delivery along rural letter carrier lines and in island settlements
If your delivery address is along rural letter carrier lines and outbuildings without a normal bridge connection, the delivery time may be extended by 2-3 non-holiday weekdays.

Delivery delay
If a delivery delay arises that is of significant importance to you as a customer, you have the right to terminate this agreement free of charge or if Byswedes AB can not satisfy a delivery time that is decisive for the customer to enter into the agreement and the customer has notified this before entering into the agreement. In the event that the purchase is intended for a product that is to be adapted, manufactured or specially procured according to the customer's wishes and Byswedes AB can not take back the product without significant loss, the customer is only entitled to cancel the purchase if the purpose of the purchase is materially erroneous. have realized this.

Transport risk
The risk of shipment passes to you as a customer once it has been delivered to you. This means that Byswedes AB bears the transport risk until the shipment has reached you.

§8. Right of withdrawal and repurchase

Right of withdrawal
Customers who enter into this agreement in their capacity as private individuals have the right to withdraw from the agreement in accordance with the Act (2005: 59) on distance contracts and contracts outside business premises. The right of withdrawal does not apply to customers who have entered into this agreement in their capacity as traders. The right of withdrawal is valid for 14 days (the withdrawal period), the time is calculated from the day when you as a customer have received delivery. The right of withdrawal gives the customer the right to examine the goods and return them in the event the customer regrets their purchase. When the customer has regretted his purchase, he has the right to recover what he has paid, provided that the customer has not used the products to a greater extent than is required to be able to examine them. When exercising the right of withdrawal, the customer must notify Byswedes AB and then return all products covered by the order to Byswedes AB without undue delay, but no later than within 14 days. Upon return, the customer must pay for the return shipping.

When the customer has given notice that he exercises his right of withdrawal, Byswedes AB will make a refund without undue delay, but no later than within 14 days provided that Byswedes AB has received the products returned by the customer or if the customer has provided proof of return. Should you as a customer return fewer products than the order covers, only the value of the goods for the products you return will be refunded. Repayment is made with the same means of payment as the customer used to the extent that it is technically possible. Any depreciation deductions and deductions for shipping if the customer has chosen another alternative than standard shipping may be made on the refund.

Depreciation deduction when exercising the right of withdrawal
If the customer has handled the products more than is necessary to examine them and the handling has caused the products to decrease in value. For example, the value of products can be reduced through wear and tear. In these cases, the customer is liable to Byswedes AB for reasonable impairment. A market assessment of the actual depreciation is made by Byswedes AB in each individual case. The deduction levels listed below are only examples of the calculation bases that are applied when calculating the depreciation. Byswedes AB's assessment is always made from a holistic perspective.

Level 1. - If the product shows a slight wear or deterioration, such as a minor scratch:
20% in depreciation deduction.

Level 2. -If the product shows appreciable wear or deterioration, such as obvious scratching or damage:
40% in depreciation deductions.

Level 3. -If the product shows damage to the product that affects the product's function:
60% in depreciation deductions.

Level 4. -If the product shows severe damage to the product and / or severe wear or deterioration of the product:
80% in depreciation deductions.

Level 5. -If the product is in such a condition that it is judged to be unsaleable or that a repair is not economically defensible:
100% in depreciation deduction.

Damage to the product packaging
In the event that the product packaging is missing or shows such damage that it cannot be reused:
20% in depreciation deduction.

Some products are exempt from the right of withdrawal with the support of the Act (2005: 59) on distance contracts and contracts outside business premises:
-Products that have been manufactured or changed specifically at the customer's request or that have otherwise been given a special character.

30 days right of exchange
You have the right to change product for 30 days from the time the product is delivered to you. When exchanging, you get the value of the products you return in credit with Byswedes AB. Costs that you had for shipping or other services performed are not repurchased in connection with the exercise of the right of exchange. Receivables for repurchased products are deducted from the value of the products you order in connection with the exercise of the right of exchange. Should the value of the products you ordered exceed your credit, you must pay the difference to Byswedes AB. In the event that the value of the products repurchased exceeds the value of the products ordered in connection with the exchange, you can use the difference as a credit for the next purchase at Byswedes AB. When returning products in connection with a change, you as a customer must pay for the return shipping.

The following conditions apply to replacement:
-The product must be unused and in undamaged condition.
-Any installation of the product must not have taken place.
-The original packaging must be in undamaged condition.

§9. Complaints and warranty

Right of complaint
A customer who has purchased a product in his capacity as a private individual has the right to complain about the product if it is incorrect in accordance with the Consumer Purchase Act (1990: 932) together with the Consumer Services Act (1985: 716). The right of complaint covers original defects and is valid for 3 years from the time the customer received the product in their possession. The right of complaint also covers errors that have occurred during transport of the product to the customer. (see Complaint of transport damage below). A product that deviates from what has been agreed between the customer and Byswedes AB or otherwise shows errors can also be considered incorrect. Errors that have occurred due to damage caused by the customer are not counted as original errors.

If the customer complains about a faulty product after 6 months from the customer's receipt of the product, the customer is also responsible for proving that the fault in the product was original. Byswedes AB therefore always recommends examining products when they are delivered and pointing out any errors as soon as they are discovered. In the event of a complaint about a faulty product, you as a customer are in the first instance entitled to have the fault rectified, or alternatively a fault-free product. In some cases, you also have the right to terminate the agreement and get back what you paid. In the event of an approved complaint, the customer shall be indemnified for any costs that arise due to the complaint. As an example, costs for returning a faulty product shall be reimbursed by Byswedes AB. Note that you as a customer should, as far as possible, minimize any costs that arise in the event that a product turns out to be incorrect. In the event of a complaint, each party shall return without undue delay what it has received, in the event that Byswedes AB is to undertake re-delivery, the customer has the right to keep the faulty product in his possession until he has received delivery of faultless product.

Complaint terms for Traders
If a product deviates from what has been agreed between the customer and Byswedes AB or otherwise shows errors for which Byswedes AB is responsible, the customer has the right to have the error remedied in the first instance and in the second instance the product replaced at Byswedes AB's expense. The right to complain about errors only applies if the error is original, Byswedes AB's liability is limited to the value of the incorrect product. Defective situation must be reported within 20 days of delivery by contacting Byswedes AB via e-mail at order@byswedes.se.

§10. Returns

When returning products or materials to Byswedes AB, the products must be packaged in such a way that they are protected during transport. Byswedes AB therefore recommends that you always pack products in the same way and with the same packaging as when the products were delivered to you. In the event that you have packaged or packaged products in a substandard manner and the product is damaged during transport to Byswedes AB, you as a customer are also responsible for the damage.

When returning products to Byswedes AB, you are responsible for the products reaching Byswedes AB in undamaged condition. Byswedes AB recommends that the customer use a traceable consignment when returning.

§11. Reservation

Subject to change
Byswedes AB reserves the right to change the content of the website without notice, which includes, but is not limited to, offers, prices and promotions. However, such a change does not affect agreements already entered into between Byswedes AB and the customer.

§12. Exemption from liability

Force majeure
In the event of government action or omission, new legislation, labor law conflict, war or danger of war, major disturbance of public order, sabotage, extreme weather conditions, fire, explosion, natural disaster, accident or other circumstance beyond Byswedes AB's control and which Byswedes AB could not reasonably have overcome or anticipate, Byswedes AB shall have the right to waive its obligations in this Agreement. In such an event, Byswedes AB shall not be liable for damages in the event of damage suffered by the customer.

Reservation for price fluctuations or other trade barriers
In the event of price fluctuations or other barriers to trade, such as a lack of the necessary component, where Byswedes AB cannot reasonably be held to its obligations under this agreement, Byswedes AB has the right to terminate the agreement. In such an event, the customer is not entitled to damages or other compensation from Byswedes AB.

Reservation for tax and fee changes
In the event of significant tax or fee changes, which are of great importance for the conditions of this agreement, Byswedes AB has the right to terminate the agreement. In such an event, the customer is not entitled to damages or other compensation from Byswedes AB.

Reservation for delivery delay outside Byswedes AB's control.
If a delivery delay arises due to an event beyond Byswedes AB's control, Byswedes AB shall not be held liable for damage due to such delivery delay. In such an event, the customer is not entitled to damages or other compensation from Byswedes AB unless otherwise specifically agreed between Byswedes AB and the customer or a provision that follows from mandatory law.

§13. Personal data and confidentiality

Information such as personal information or other information or part of a document that the customer submits to Byswedes AB will be stored and processed in digital format. Byswedes AB is responsible for the data being stored and processed in accordance with the Personal Data Act. The customer's information will be used by Byswedes AB to enable and ensure fulfillment of the Agreement and for marketing purposes by the company.

Registry excerpt:
If you as a customer have entered into this agreement as a private individual, you have the right to request a register extract once a year free of charge. A register extract indicates what information is stored about you. You request this by sending a signed request to the above postal address. Of course, if the information we have about you is incorrect, incomplete or misleading, we will correct it.

Deregistration of customer information:
You as a customer can, upon written and signed request, have your customer information with Byswedes AB deleted, subject to such information as is required for Byswedes AB to be able to maintain good accounting and bookkeeping practice.

§14. Other

Report to the police
Byswedes AB routinely reports all frauds and attempted frauds to the police.

Discrepancy between different publications
If there are differences between information on the website and other publications, the information provided on the website shall take precedence. However, this does not apply to information that is clearly incorrect or misleading in a comparison between the various publications.

Intellectual property rights, logos and trademarks
All material published on the website, including software, logos, audio files, trademarks and text & image is protected by intellectual property rights. The protection means that the material may not be used without the right holder's permission, nor may the material be copied or otherwise transferred to third parties without Byswedes AB's express permission. Any violations will be prosecuted.

Purpose of the information
All information on the website, regardless of format, is published for informational purposes only so that visitors can use the website. Byswedes AB is thus not responsible for the consequences or damages that may arise if this information is used for any purpose other than that stated above.

Cookies
Cookies, "cookies", are small files that are saved on the visitor's computer when he visits a website. The website uses the following types of cookies:

If the customer is a private individual and has entered into this agreement for private consumption, a dispute shall be tried in the court that follows from mandatory legislation. In the event that a case is tried in the General Complaints Board, Byswedes AB will follow the board's decision.

Returns & exchanges

Right of withdrawal

Full right of withdrawal applies for 14 days from the time you received the item. Upon return, the product must be in unused condition and returned in the packaging in which the product was delivered. By unused condition is meant that the product has not been tested, is complete and clean and in salable new condition. Always send the item together with a receipt, invoice or order confirmation and state the reason for return.

    Upon approved return, the sum for the returned item or in some cases the entire order amount is refunded. In the normal case, we automatically refund back to the account used in connection with the purchase. You as a customer are responsible for return postage.

Byten

We offer a 30-day right of exchange for goods in unused condition. The right of exchange applies, for example, when changing a motif or format on a painting. Call or email and we will agree on something you are happy with. You as a customer are responsible for return postage and any shipping costs for the new product.

​ Complaint

In the event that a product has a defect or a manufacturing defect that was not caused by the transport or negligent handling of the customer, we can accept complaints. Contact us by email or phone before you return the wrong product. In the event of an approved complaint, we refund the amount for the return and are responsible for the return postage.

​ Cost for uncollected packages

If you regret your purchase before you receive your item, you should still pick up your package and then send it back to us. We charge an administrative fee of SEK 250 for uncollected packages. The reason is that we as the sender of a package that has not been picked up become liable to pay to agents and the entire handling is time consuming.
